Backdrops Terms of Use

Definitions Used in this Agreement

1. Exclusive Content:

Images and content published under the Backdrops license and owned by Backdrops.

2. User Generated Content (UGC):

Images published by our Users that have been reviewed by the Backdrops Team and approved for the Community page within the Backdrops app.

3. User:

An individual using the Backdrops app in accordance with this Agreement.

4. User Account:

An account available to the User after they have successfully signed in with Google or Apple services.

5. Objectionable and Forbidden Content:

Images and content that are NOT allowed on the Backdrops app.

Sharing Our Exclusive Content is Prohibited

The Backdrops team designs all wallpapers ("exclusive content") in the Explore tab (including our Premium & Pro Collections) within the Backdrops app. Sharing these walls outside of the Backdrops app is strictly forbidden. You CAN NOT share any of the exclusive content, even if you are a Pro member. Saving the walls in the Explore tab (including our Premium and Pro collections) to your device is for personal use only (e.g., editing and cropping to your liking). We have the right to hold you responsible and pursue legal action if you share our exclusive content without our permission.

User Generated Content (UGC) and Prohibited Content

We let our community of users upload and share their own wallpapers, creations, and/or photos to our Community section for possible approval. All uploaded submissions are always pending and reviewed before approval. This content is governed by our Terms of Use and heavily moderated for quality control. There are obvious limitations in place, and we deny and reject all objectionable and prohibited content, as outlined below.

The following types of content are FORBIDDEN and NOT allowed on the Services ("Prohibited Content"):

• 1. Pornography: Images or illustrations which contain any depictions of sexual acts, or sexual content in any way, even if censored.
• 2. Nudity: Images or illustrations of people or characters which contain naked body parts.
• 3. Minors: Images in which minors are depicted sexually, consuming alcohol, or drug substances.
• 4. Violence and shocking content: Images depicting violent acts against humans, animals, disasters, tragic events, terroristic acts, and anything justifying such actions.
• 5. Firearms and weapons: Images or instructions of weapons, guns, explosives, and threats to use such devices.
• 6. Alcohol and controlled substances: Images or any propaganda of consuming such substances or creating a positive impression of their usage.
• 7. Gambling: Images that attract or advertise gambling in any way.
• 8. Copyright infringement: Images or illustrations that you do not own or have the proper authorization to share.
• 9. Stock images: Images that were obtained on stock image services or other similar platforms.
• 10. Harassment and insults: Images and content created with the purpose of offending, humiliating human dignity on any basis (race, gender, political views, religion, sexual orientation, etc.) as well as anything using obscene language.
• 11. Stalking, doxing, and personal data: Images and content which contain personal data or information which helps to identify or stalk other people.

We have the right to remove or modify any uploaded content for any reason at any time, including user content that we believe constitutes Prohibited Content, or violates these Terms of Use. If you post Prohibited Content, as decided in our sole discretion, we may ban you and report you to the authorities only in appropriate circumstances.

Encouraged Content

The following types of content are encouraged for uploading to the Backdrops app:

• Original work.
• Your own photography.
• Your own digital creations and/or designs.
• Public domain content.
• Content that you have permission from the original creator to upload & share.

If your uploaded content complies with our Terms of Use, then it may be approved to be shown within the Community tab in the Backdrops app. We still hold the right to delete, remove, or modify any uploaded content for any reason at any time, even if it doesn't contain any prohibited content. For example, if the quality of the uploaded content isn't high enough, in terms of design and/or resolution. Watermarked images may be denied or modified to remove the watermark before approval.

Claims of Copyright Infringement

We monitor and approve uploaded content that complies with our Terms of Use to the best of our knowledge. If you see anything on the Backdrops app that you believe infringes your copyright rights, please contact us at support@backdrops.io with the following information so we can easily remove it:

• Identification of the copyrighted work(s) claimed to have been infringed (for example, a copy of or link to your original work).
• Identification of the material on our servers and information sufficient to allow us to locate and remove the material (e.g., the name given to the allegedly infringing content on the Backdrops app and their username).
• A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by you as copyright owner, or by your agent, or by law (e.g., the use is not allowed by Section 107 of the U.S. Copyright Act).
• A statement that the information in your notice is accurate, and under penalty of perjury, that you are the owner (or authorized to act on behalf of the owner) of the exclusive copyright right that is allegedly being infringed.
• Your physical or electronic signature, or of someone authorized to act on your behalf.
• Instructions on how we may contact you, including email, address, and phone number.

We respond to notices of claimed copyright infringement in accordance with the Digital Millennium Copyright Act (DMCA). It is our policy to terminate the account of any user we determine, in our sole discretion, to be a repeat infringer of copyrights.

Fees and Charges

The Backdrops app contains In-App-Purchases (IAPs) to unlock more features and content. Please be aware that IAPs are non-refundable. Make sure you require authentication for all purchases within the Apple App Store and Google Play Store's settings to avoid accidental purchases. It's a great feature.

The Backdrops app consists of high-quality wallpapers. Regular usage can use a lot of data. Please be aware that your Internet Service Provider or mobile carrier's normal rates and fees may apply to your use of Backdrops. You are solely responsible for such charges and fees.

Streaks Feature

By using the Streaks feature within the Backdrops app, you agree to the following terms and conditions. Please read them carefully to understand your rights and responsibilities as a user.

1. Nature of Streak Coins

Streak Coins are a virtual in-app currency used solely within the Backdrops app to unlock wallpaper collections and other related features.

Streak Coins hold no actual monetary value and cannot be exchanged, traded, or redeemed for real-world currency, goods, or services. Users further agree that Backdrops is not liable for any compensation or damages if Streak Coins are lost, removed, or rendered unusable due to changes to the app, feature discontinuation, or other circumstances.

Ownership of Streak Coins does not imply ownership of any tangible or intangible property. Streak Coins are non-transferable.

2. Earning Streak Coins

Users can earn one (1) Streak Coin every 24 hours by logging into the app and claiming it through the Streaks feature.

The Streak Coin counter resets at the end of each 24-hour period based on server time after the last coin claimed.

Additional opportunities to earn Streak Coins may be provided through promotional events or as explicitly stated within the app.

3. Usage of Streak Coins

Streak Coins can only be used within the Backdrops app to unlock collections or features specifically designated as redeemable.

Once spent, Streak Coins are non-refundable, even if the unlocked content is no longer available or accessible for any reason.

4. Prohibited Activities

Users are prohibited from:

• Manipulating device settings to bypass the 24-hour claim period.
• Using automated tools or bots to collect Streak Coins.
• Exploiting bugs, loopholes, or vulnerabilities in the app to gain unauthorized Streak Coins.
• Selling, trading, or transferring Streak Coins or related accounts to other users.

Any attempt to engage in these activities will result in penalties, including but not limited to:

• Suspension or permanent ban of the user's account.
• Revocation of all accumulated Streak Coins.
• Reporting of fraudulent activity to appropriate authorities if deemed necessary.

5. Loss of Streak Coins

Backdrops is not responsible for any loss of Streak Coins due to app uninstallation, account deletion, technical issues, server errors, or any other reason.

It is the user's responsibility to ensure they comply with the app's rules to maintain access to their Streak Coins.

6. Termination of Streaks Feature

Backdrops reserves the right to modify, suspend, or discontinue the Streaks feature at any time, with or without prior notice.

In the event of termination, users will not be entitled to compensation or reimbursement for unused Streak Coins.

7. Acknowledgment

By using the Streaks feature, you acknowledge that you have read, understood, and agreed to these terms of use.

If you do not agree to these terms, you should not use the Streaks feature.

Termination

We will terminate your account if we determine you to be a repeat infringer of copyrights. We may also terminate your account without prior notice under appropriate circumstances if you violate these Terms, or for any other reason, in our sole discretion. Backdrops shall not be liable to you or any third party for any termination of your access to the Services. You agree that upon termination of your account, we may delete all uploaded content and information related to your account, if any, without any obligation to return/transmit to you any such uploaded content and/or information.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BACKDROPS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES, INCLUDING WITHOUT LIMITATION, ANY DEFAMATORY, OFFENSIVE OR ILLEGAL CONDUCT OF OTHER USERS OR THIRD PARTIES; OR (C) UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

Terms of Use Changes

We reserve the right, at our sole discretion, to change or modify portions of these Terms at any time. If we do this in a way that changes your rights, we will post the changes on this page and will indicate at the top of this page the date these terms were last revised. We may require you to provide consent to the updated Terms before further use of the Services is permitted. Otherwise, your continued use of the Services after the date any such changes become effective constitutes your acceptance of the new Terms. If you do not agree to the amended Terms, you must stop using the Services. However, any dispute that arose before the changes shall be governed by the Terms that were in place when the dispute arose.
